Background

Digitalisation and interest in digital assets have grown significantly in recent years. In October 2022, the Hong Kong Government set out its policy stance and approach towards developing a vibrant sector and ecosystem for Virtual Assets (VA) in Hong Kong.

The Securities and Futures Commission (SFC) was one of the first few major financial regulators to introduce a comprehensive framework to regulate a wide range of VA-related activities, from trading on centralised VA trading platforms to services provided by SFC-licensed intermediaries (e.g., virtual asset fund management, discretionary account management, provision of virtual asset dealing and advisory services).

Upon commencement of the licensing regime for virtual asset service providers (VASP) on 1 June 2023, all centralised VA trading platforms carrying on their businesses in Hong Kong, or actively marketing their services to Hong Kong investors, will need to be licensed and regulated by the SFC, irrespective of whether they provide trading services in security tokens.
